1. Definition

Delivery refers to the transfer of physical possession or control of the goods to the consumer.

2. Delivery Time

Available in-stock products are delivered to the buyer within an average of 7 working days in mainland France for any order placed before 12:00 pm. In the event of a delay of more than 10 days beyond the expected delivery date, excluding cases of force majeure or fault on the part of the buyer (such as missing or incorrect personal information), the buyer is entitled to terminate the contract by sending a registered letter with acknowledgment of receipt to the following postal address:

The contract will be considered terminated upon receipt of the letter by Terre d'Oc, provided that the products have not been delivered by Terre d'Oc before receipt of said letter. The buyer must exercise this right within 60 working days from the delivery date indicated at the time of order placement on the website.

3. Place of Delivery

Products are delivered to the address provided by the customer on the order form. The buyer is required to provide all necessary details to ensure successful delivery (exact address, door code, full address, phone number, email address, etc.). If these details are missing or incorrect, our company cannot be held responsible for delivery failure. In such cases, the products will be returned to our company's warehouse, and the buyer must contact our Customer Service, whose contact details are listed in Article 1, to learn the steps required to retrieve the ordered products. Our company disclaims any liability for delays in the buyer's retrieval of the products or for the costs of re-shipment.

4. Delivery Methods

Delivery is made either by directly handing over the product to the buyer or, failing that, by the seller sending a notice of availability to the buyer.

The buyer must collect the ordered product within fifteen days from the notice of availability.

If the product is not collected within this period, the seller may, after a formal notice to the buyer that remains unanswered, recover the product, automatically terminate the order, and retain any sums paid as compensation.

When the product is delivered to the address specified on the order form via a carrier, it is the buyer's responsibility to check the condition of the delivered product in the presence of the delivery driver. In the event of damage or missing items, the buyer must note reservations on the delivery slip or transport receipt and may refuse the product if necessary, informing the seller accordingly.

5. Product Compliance

If the product does not conform to the order, the consumer must submit a claim to the professional seller in order to obtain a replacement product or, if necessary, the cancellation of the sale.

6. Product Unavailability

If products are unavailable at the time of delivery, the professional seller may offer, under the conditions set out in Article 3-4 of the General Terms and Conditions of Sale (GTC), a product of equivalent quality and price.

7. Failure to Deliver

The total failure to deliver will result in the automatic termination of the sales contract.

8. Delivery and Risk Transfer

The risks of loss or damage to the goods are transferred to the consumer when they, or a third party designated by them, take physical possession of the goods, regardless of the nature of the goods.

When the product is delivered to the consumer by a carrier selected by the consumer, the goods are transported at the consumer's risk from the moment the product is handed over to the carrier.

9. Transfer of Ownership

Ownership of the product is transferred to the buyer as of the delivery date specified on the order form.
