General Sales Terms and Conditions

Article 1 - Identification of the Seller

Article 2 - General Provisions Regarding the General Terms and Conditions of Sale (hereinafter referred to as "GTC")

2.1. Purpose of the GTC

The GTC exclusively apply to the online sale of products by Terre d’Oc Evolution on the website terredoc.com, which is freely accessible to all internet users.

2.2. Scope of the GTC

The GTC exclusively govern online sales contracts for products sold by Terre d’Oc Evolution (hereinafter referred to as the "professional seller") to consumers (hereinafter referred to as "consumers"). The GTC, together with the online order, constitute the binding contractual documents for the parties, excluding all other documents such as brochures, catalogs, or product photographs, which are for information purposes only.

The GTC only apply to products delivered to consumers residing in France.

The GTC and all contractual information on the website are written in French.

For the purposes of these GTC, the term "Client" refers to a consumer as defined by Law No. 2014-434 of March 17, 2014.

2.3. Availability and Enforceability of the GTC

The GTC are made available to consumers on the seller's website, where they can be accessed and consulted directly. They can also be provided upon simple request via telephone, email, or postal mail.

The GTC are binding on the consumer, who acknowledges having read and accepted them by ticking a box provided for this purpose before placing an order.

Confirmation of an order implies acceptance of the GTC in force at the time of the order, which are preserved and stored by the professional seller in accordance with Article 1127-2 of the French Civil Code.

2.4. Changes to the GTC

The professional seller reserves the right to modify the GTC at any time.

In the event of changes to the GTC, the applicable version will be the one in force on the date of the order. A dated copy may be provided to the consumer upon request.

2.5. Clauses of the GTC

If any clause of the GTC is found to be null or void, it does not invalidate the entirety of the GTC, unless it is a decisive clause that led one of the parties to enter into the contract.

The temporary or permanent non-application of one or more clauses of the GTC by the professional seller does not constitute a waiver of the other clauses, which remain in full force and effect.

Article 3 - Products

3.1. Product Features

The products offered for sale in the online catalog are each described in accordance with Article L. 111-1 of the French Consumer Code, specifying their essential characteristics.

The photographs illustrating the products are not considered contractual documents.

3.2. Product Compliance

The products comply with the applicable regulations concerning the safety and health of persons, fairness in commercial transactions, and consumer protection when they are placed on the market.

3.3. Stock Availability

The products are offered for sale and delivered subject to stock availability.

If a product ordered is unavailable, the seller will notify the buyer immediately and may offer a product of equivalent quality and price or, failing that, a voucher equal to the value of the order, which can be used for future orders.

If the buyer does not agree to this substitution, the seller will refund the amounts paid within 30 days.

Except for the refund of the unavailable product, the seller is not obliged to provide any additional compensation unless the breach of the contract is attributable to the seller.

3.4. Samples of Organic Tea/Herbal Tea

4 free samples of organic tea or herbal tea are offered for any order of €25 or more (excluding shipping fees), subject to stock availability.

Article 4 - Prices

4.1. Sale Prices

The sale prices are listed for each product in the online catalog, in euros, inclusive of all taxes (TTC), excluding shipping and transport fees, which are displayed before order validation and are billed in addition.

The total amount payable by the consumer is displayed on the order confirmation page. The product price is the price in effect on the order date. Shipping costs are not included in the product price and are billed separately.

If a promotion is offered, the seller undertakes to apply the promotional price to all orders placed during the promotional period.

The prices are subject to French VAT, and any changes to the applicable VAT rate will be automatically reflected in the product prices displayed on the Terre d’Oc website, in accordance with the implementation date set by the corresponding decree.

4.2. Price Changes

The seller reserves the right to modify product prices at any time, but the price applicable to the consumer is the one in force at the time of the order.

4.3. Additional Fees

Additional fees for shipping, delivery, or postage (and any other charges incurred by the seller) are specified on the order form, which the customer reviews before confirming their order.

Article 5 - Offers

5.1. Scope

The online sales offers displayed on the website are intended for consumers residing in mainland France for delivery within this geographical area.

5.2. Offer Duration

Unless otherwise specified, the online sales offers remain valid as long as the products are available in the online catalog and within the limits of available stock.

5.3. Acceptance of the Offer

The consumer's acceptance of the offer is validated using the double-click process, whereby the consumer confirms the order after reviewing its details and total price.

Article 6 - Orders

6.1. Steps to Conclude the Contract

To place an order, the consumer must:

  1. Add selected products and quantities to the shopping cart.
  2. Click "Order" and provide delivery and payment information.
  3. Review the order summary, including product details, quantities, and total price, and make any necessary corrections.
  4. Click "Confirm Order" to finalize the order.

The order confirmation constitutes acceptance of the GTC and forms a binding sales contract.

The seller sends an order confirmation email as soon as possible after the order is placed.

6.2. Order Changes

Any change to an order by the consumer after confirmation is subject to the seller's approval.

The seller may make technical modifications to the product ordered in accordance with Article R. 212-4 of the French Consumer Code.

6.3. Order Validation

The seller reserves the right to refuse any order for legitimate reasons, especially if the quantities ordered are abnormally large for a buyer classified as a consumer.

6.4. Gift Offers

For purchases above a minimum threshold specified in the purchase offers, the client accepts the receipt of free tea bag samples when confirming the order.
